Terms of Service - LoLDraftAI

Article 1: Purpose and Scope

These Terms of Service (hereinafter "ToS") define the terms and conditions under which NIEDZIELSKI Filip Aleksander, Individual Entrepreneur (hereinafter "the Provider") provides access to the LoLDraftAI SaaS platform and its associated services to consumers and professionals (hereinafter "the Client" or "the User").

They apply to all subscriptions and services offered on the website https://loldraftai.com, to the exclusion of any other document. By subscribing, the Client fully accepts these ToS.

Article 3: Services Offered

3.1 Service Description

LoLDraftAI is a SaaS (Software as a Service) platform providing an analysis and decision-making tool for the draft phase of League of Legends. The service uses artificial intelligence to:

  • Analyze team compositions (drafts) in real-time
  • Calculate win probabilities based on selected champions
  • Recommend the best champions to select according to draft context

The service is accessible via a basic monthly subscription providing access to:

  • Analysis results for all champions
  • Analysis results for all elos except "pro"

The service is also accessible via a pro monthly subscription providing access to:

  • All features of the basic subscription
  • Analysis results for "pro" elo

3.2 Service Availability

The Provider commits to implementing all reasonable means to ensure service availability 24/7. However, the Provider reserves the right to temporarily interrupt access to the service for planned or emergency technical maintenance.

3.3 Service Evolution and Model Updates

The Provider reserves the right to evolve service features, add new ones, remove them, or discontinue the service entirely. In case of complete service or specific subscription plan discontinuation, the Provider will:

  • Provide at least 30 days' advance notice to affected Clients
  • Cancel affected subscriptions and cease billing
  • Issue pro-rata refunds for any prepaid but unused subscription periods

The Provider maintains full discretion over the AI model and algorithms used to provide the service, including but not limited to:

  • The frequency and timing of model updates
  • The decision to deploy new model versions
  • The specific data and patches on which models are trained
  • The methodology and architecture of the predictive systems

While the Provider endeavors to maintain and improve model performance to reflect game updates and meta changes, no guarantee is made regarding:

  • The frequency of updates following new game patches
  • Specific performance metrics or accuracy rates
  • Immediate availability of analysis for newly released champions or major game changes

All model updates are deployed at the Provider's sole discretion. The Provider ensures that any deployed update aims to either:

  • Improve prediction accuracy or performance
  • Add new features or capabilities
  • Incorporate more recent game data
  • Enhance user experience

The Client acknowledges that prediction quality may temporarily vary following major game updates until the model is retrained on new data.

Article 4: Subscription Process

4.1 Account Creation

To subscribe, the Client must:

  1. Create a user account on https://loldraftai.com
  2. Provide accurate and up-to-date information
  3. Choose a subscription plan
  4. Accept these ToS
  5. Proceed with payment

4.2 Subscription Validation

The subscription is considered active upon:

  • Payment validation by the payment provider
  • Sending a confirmation email to the Client
  • Activation of premium service access on the user account

4.3 Duration and Renewal

Subscriptions are offered for the following durations:

  • Monthly subscription: automatically renewed each month

Automatic renewal can be disabled at any time from the client area, before the renewal date.

Article 5: Pricing and Payment Terms

5.1 Pricing

Subscription rates are:

  • €3.99 including tax/month for the basic monthly subscription
  • €19.99 including tax/month for the pro monthly subscription

Prices are expressed in euros, all taxes included. The Provider reserves the right to modify prices at any time, with the understanding that price changes will only apply to new subscriptions and renewals after the modification.

5.2 Payment Methods

Payment is made by credit card (Visa, Mastercard, etc.) via our secure payment provider Stripe. The bank card data is directly processed by Stripe and never stored on our servers.

5.3 Billing

An invoice is automatically generated and sent by email for each payment. Invoices are also available in the client area.

5.4 Payment Default

In case of automatic debit failure:

  • The Client is notified by email
  • A 7-day grace period is granted to regularize payment
  • After this period, access to premium services is suspended
  • After 30 days without regularization, the subscription is terminated

Article 6: Right of Withdrawal

6.1 Principle

In accordance with Article L221-18 of the French Consumer Code, consumer Clients have 14 days from subscription to exercise their right of withdrawal without justification or penalty.

6.2 Exception for Immediate Execution

If the Client wishes to benefit immediately from the service, they expressly waive their right of withdrawal by checking the box provided for this purpose during subscription, in accordance with Article L221-28 of the Consumer Code.

6.3 Exercise Procedures

To exercise the right of withdrawal, the Client must notify their decision by email to support@loldraftai.com or via the site's contact form. Refund will be made within a maximum of 14 days following receipt of the request.

Article 7: Termination

7.1 Termination by the Client

The Client may cancel their subscription at any time from their client area. Cancellation takes effect at the end of the current subscription period. No partial refund is granted for the remaining period.

7.2 Termination by the Provider

The Provider may terminate the subscription in case of:

  • Non-compliance with these ToS
  • Fraudulent or abusive use of the service
  • Non-payment after formal notice
  • Inappropriate behavior towards other users or support team

Article 8: Obligations and Responsibilities

8.1 Provider's Obligations

The Provider commits to:

  • Provide a service as described
  • Ensure data security and confidentiality
  • Provide technical support by email
  • Inform Clients of planned maintenance

8.2 Client's Obligations

The Client commits to:

  • Use the service in accordance with its purpose
  • Not share their login credentials
  • Not attempt to circumvent technical limitations
  • Respect intellectual property rights
  • Not use the service for illegal purposes

8.3 Limitation of Liability

The Provider cannot be held responsible for:

  • Indirect damages (loss of earnings, opportunities, etc.)
  • Consequences of using recommendations provided by the service
  • Service interruptions due to external causes (hosting provider, internet provider, etc.)

The Provider's liability is limited to the subscription amount paid by the Client over the last 12 months.

Article 9: Intellectual Property

9.1 Provider's Rights

All elements of the site and service (design, texts, algorithms, databases, analysis results, etc.) are the exclusive property of the Provider or its partners. Any reproduction, even partial, is prohibited without prior authorization.

9.2 License of Use

The Client benefits from a personal, non-exclusive, and non-transferable license to use the service during their subscription period.

9.3 Generated Content

Analyses, win probabilities, recommendations, and other content generated by AI as part of service use are provided for informational and decision-making purposes. This content:

  • Remains the intellectual property of the Provider regarding algorithms and calculation methods
  • May be freely used by the Client for personal use (draft decisions, learning, etc.)
  • Cannot be resold, redistributed, or used commercially without authorization
  • Does not constitute a guarantee of results in games played

The Client acknowledges that predictions and recommendations are based on statistical and machine learning models, and actual results may vary.

Article 10: Personal Data

Personal data processing is carried out in accordance with GDPR and the privacy policy available on the site.

10.1 Data Collected

Data collected includes:

  • Account information (email, username)
  • Payment data (processed by our payment provider Stripe)
  • Service usage data

10.2 User Rights

In accordance with GDPR, the Client has rights of access, rectification, erasure, limitation, portability, and opposition concerning their personal data. These rights can be exercised by contacting: support@loldraftai.com

Article 11: Mediation and Dispute Resolution

11.1 Complaint

In case of dispute, the Client is invited to first contact customer service at support@loldraftai.com to seek an amicable solution.

11.2 Mediation

In accordance with Articles L612-1 and following of the Consumer Code, the Client may use a free consumer mediation service for amicable resolution of any dispute.

The contact details of our consumer mediator are available upon request at support@loldraftai.com.

11.3 Competent Jurisdiction

In the absence of an amicable agreement, any dispute will be brought before the competent courts of Paris, subject to public order legal provisions applicable to consumers.

Article 12: Final Provisions

12.1 Modification of ToS

The Provider reserves the right to modify these ToS. Clients will be informed by email at least 30 days before new conditions take effect. Continued use of the service after this date constitutes acceptance of the new ToS.

12.2 Partial Nullity

If any clause of these ToS is declared null or unenforceable, the other provisions will remain fully in force.

12.3 Entire Agreement

These ToS, along with the privacy policy and terms of use, constitute the entire agreement between the parties.
